The final hearing on the writ petition related the dissolution of the House of Representatives is starting from today in the Constitutional Court of the Supreme Court.

Nepali Congress Chairman Sher Bahadur Deuba and 146 outgoing MPs are about to start the final hearing of the case. The Constitutional Court of the Supreme Court had ordered the hearing to be held from Wednesday, Jesth 27. The final hearing is set to begin a month after the dissolution. As per the order, the Opposition President’s Office, Prime Minister KP Sharma Oli, Speaker Agni Prasad Sapkota and others have submitted written replies. The Office of the President has sent a reply to the President stating that during the implementation of Article 76, the President does not need the recommendation of any body and has the right to ensure a vote of confidence.

Similarly, the Prime Minister has submitted a reply to the court stating that the court cannot order any person to select the Prime Minister, the dissolution was as per the previous decision of Falgun 11, even in the case of sub-section 5, the party whip will be applied. Speaker Sapkota has submitted a reply demanding that the order be issued as per the demand of the petitioner. He replied that the vote of confidence would be tested only in the parliament.

Similarly, as per the order of the Constitutional Court, the Nepal Bar Association and Supreme Court Bar Association have also recommended to amicus curie. Nepal Bar has recommended senior advocates Raghav Lal Baidya and Usha Malla Pathak. Similarly, the Supreme Court has already recommended senior advocates Komal Prakash Ghimire and Prakash Bahadur KC.
