It is not up to the legal practitioner to decide which judge to hear in the writ petition: Chief Justice Rana

Chief Justice Cholendra Shamsher Jabara has said that the legal practitioners do not have the right to decide which judge to have in the hearing of the writ petition.

Stating that 11 judges should not be seen in the dispute, he urged to withdraw the petition filed by the lawyer. Chief Justice Rana also warned the lawyer who filed the petition today that the court would take action for contempt if the petition was not withdrawn.

Advocate Rajaram Ghimire said that 11 senior judges, including those included in the Constitutional Court today, have filed a petition stating that the case should not be heard.

The petition states that former judges Kalyan Shrestha and Sushila Karki, who came from the parliamentary hearing, should not be appointed to the bench.

Objection to the Constitutional Court

Attorney General Ramesh Badal has objected to the constitutional bench constituted by the Chief Justice today. As soon as the hearing began in the courtroom, he asked, “Why were two judges removed? Why were the two judges left behind?”

The Constitutional Court has again raised questions about the dissolution of the House of Representatives and the hearing of the writ petition regarding the formation of the government in accordance with Article 76, Clause 5 of the Constitution.

The Constitutional Court is chaired by Chief Justice Rana and praised over by senior Justice Deepak Kumar Karki and Justice Meena Khadka, Ishwar Prasad Khatiwada and Ananda Mohan Bhattarai.

Though Judge Harikrishna Karki is in the third petition on the basis of seniority, he has not sat in the bench after the question was raised about being the Attorney General during the previous Oli government. After that, the bench has been formed on the basis of seniority order.
